The WavegrinderTM
fin is warranted against breakage during normal use while surfing, not including
breakage due to striking reefs or any other object, for the first 60 calendar
days from the date of purchase. Wavegrinder reserves the right to repair or
replace the fin, shipping to be paid by customer. Except as stated, there are
no other express or implied warranties of any kind.
Risk,
Responsibility, Warning, and Assumption
Surfing can be
hazardous to your health. Seriously, surfing involves certain risks inherent to
the sport, risks both from natural conditions, unpredictable unknown conditions,
and from human-made devices such as surfboards and fins. Just as coffee
drinkers assume the risk that the coffee might be hot and skydivers accept the
risk of their sport, surfers must accept both the known and the unknown risks of
surfing. By pushing "add to cart," above and also by purchasing a fin, the
buyer of the WavegrinderTM fin knowingly assumes all known and
unknown risks in any way related to the product, including sharp edges of this
performance fin, agrees to hold harmless and not to sue the manufacturer and all
persons or entities in the stream of commerce related to the product including
without limitation surf shops that provide demo fins, and agrees to defend and
indemnify said persons in all circumstances should that become necessary. The
buyer further agrees that he or she is over the age of 18 years (parents or
guardians of minors must agree for minors) and agrees to the application of
California law, to jurisdiction and venue in San Diego, California, and to AAA
binding arbitration of any dispute.
